Ninth Circus Judge Strikes Again and Writes Solitary Opinion that DOMA is Unconstitutional

www.LC.org

The most reversed judge on the most reversed federal court of appeals has struck again, writing in his own solitary opinion that the federal Defense of Marriage Act (DOMA) is unconstitutional.

In an employment dispute case involving an employee in the Federal Public Defenders' Office in the Central District of California, Judge Stephen Reinhardt of the Ninth Circuit Court of Appeals said that the federal DOMA is unconstitutional. He ordered the director of the Administrative Office of the United States Courts to enroll Tony Sears, with whom employee Brad Levinson obtained a California same-sex marriage license, in the federal spousal insurance program.

It is unlikely that the Obama administration's Department of Justice will intervene to defend the federal DOMA in this case. Regardless of whether the DOJ intervenes, the ruling has no precedential value, so it will not affect other cases. Except for this particular situation, the federal DOMA remains in full effect.

Read our News Release for more details on this regretable ruling.

"Stimulus" Bill Update

Sen. Jim DeMint proposed an amendment to the "stimulus" package to remove the bill's prohibition on funding for modernization of higher education facilities where religious groups meet. However, the amendment failed by a vote of 43-54 (with all 2 Republicans -- both Senators from Maine -- voting "no".) In a debate over the amendment, Sen. Durbin mischaracterized the effect of the amendment and focused on irrelevant portions of the bill's wording. Sen. DeMint was not allowed to set the record straight. It is not too late to contact your Senators and urge them to reconsider Sen. DeMint's amendment. Contact your Senator today.

Report: Pro-abortion governor near top for health post - As for me, the worst Abortionist Governor, ever in American politics may be nominated by Obama to head Health and Human Services (HHS). You would think HHS was all about life; notso, with Kansas Democrat Governor Kathleen Sebelius. - oyh
Jennifer Loven - Associated Press Writer - 2/8/2009 6:50:00 AM

http://www.onenewsnow.com/Politics/Default.aspx?id=413600

WASHINGTON - Kansas Gov. Kathleen Sebelius was near the top of President Barack Obama's list of candidates to head the Health and Human Services Department, a senior administration official said Saturday.

The source, speaking on the condition of anonymity to discuss private administration deliberations, said no decision was imminent and that other candidates remain in the mix. But the official added the former Kansas insurance commissioner was rising as Obama considers prospective candidates, in no small part on the strength of her close relationship with the president.

Sebelius would be Obama's second choice for the slot. Former Sen. Tom Daschle had to withdraw his name amid an admission he had not paid taxes on a car and driver since leaving Congress as a Democratic leader.

White House spokesman Reid Cherlin on Saturday said no decision had been made.

Sebelius was an early Obama supporter, picking his presidential campaign over that of Hillary Rodham Clinton, now the secretary of state. Sebelius worked tirelessly for Obama's bid and was a top surrogate to women's groups.

“Chuck Sproull” - Springville IN

Here is a fundamental and practical revelation I had recently about the criminal nature of all who consent to and perform abortions.

"PRO-CHOICE" IS A MYTH. It is the result of a popular but dishonest "non-sequitur" (Latin for "the conclusion does not follow the premise").

Women who believe they have a "right" to do what they want to with their own bodies, think they can have unwanted babies aborted. This conclusion is wrong for the following reasons:

The baby is not part of the woman's body, so neither she nor an abortionist has any "right" to harm the baby in any way. At the moment of conception, when the woman's seed is fertilized by a male sperm, the resulting embryo and fetus is very sacred. He or she begins the process of developing into a living person and (a) the baby owns his/her own body! The mother's body is only the baby's temporary dwelling place. (b) In fact, the baby owns the mother's body! From the moment her seed is fertilized until months after its birth, the baby changes the mother's physical and biochemistry processes to fill its own needs. Mother's breast milk is the healthiest beverage for the baby. (c) Biologically he/she also belongs jointly to the man who begot it, and (d) spiritually belongs to God who created the entire birth and life process for His purpose. (e) Anything that kills the fruit of conception, regardless of the stage of birth (pre- or partial birth), is murder; it is a sin against our Creator's purpose. Loving parents can care for any child that is born, regardless of its condition.

The one and only "right" (God-given, responsible freedom) the pregnant woman has, is to care for the baby for about 9 months and give it a successful birth into the world. Then, along with help from the husband, they both have the "right" to raise it to be a responsible, normal boy or girl who will grow up, and marry, and bear and raise the next generation of responsible, normal children. What is the opposite of a "right"? A "wrong."

The tax-payer-funded, profit making industry dishonestly called "Planned Parenthood," really should be called "Prevented Parenthood." They are nothing more than Planned un-Parenthood (PU) trying to solve problems
caused by public school-induced un-Planned Parenthoods (UPPs). When a mature young man and a woman engage in normal marriage for the purpose of raising a family, this is the most honest thing to do, and this is
real "Planned Parenthood."

(2) Wanted babies are the fruit of normal marriage. What would you think of a farmer or gardener, who has fun sowing good vegetable and flower seeds into the soil; but after the seeds began to germinate and even sprout just above the ground, would consider them unwanted and mutilate them and kill them with a plough or herbicide, just so that he wouldn't have to be responsible for tilling out the weeds and caring for the plants until they produce their intended produce? A fool.

So, likewise, why are man and woman allowed to engage in sex just for their own temporary selfish pleasure, unless it is to consummate normal marriage and bring forth wanted children? They do not have a "right" to commit the sins of fornication and adultery, nor any or the more perverse forms of sex (like incest, sodomy or homosexuality). Any type of sexual relationship that does not produce children, is a sin against the purpose of God. Also, population control, a good Global Community concern, can be accomplished by teaching responsible and
self-disciplined sex within normal marriage, and maturity to provide all the needs for their family.

Anyone who encourages or politically supports abortion, is expressing profane disregard for the major milestones on the path of life (normal marriage, fertilization, birth, maturity, normal marriage, fertilization, birth, maturity .... etc - generations, healthy society, civilization.

"Therefore, choose life, that both thou and thy seed may live" (Deut 30:19).

HR 45 — "Gun Rights Licensing Test"

http://mensnewsdaily.com/2009/01/21/gun-law-update-gun-rights-testing-planned-part-ii/

Illinois congressman Bobby Rush, from Obama’s home state and with a voting record on gun ownership as bad as Obama’s, introduced a bill on the first day of the 111th Congress that shows what we can expect. If we don’t defeat this bill, and others expected to follow it, gun owners will lose guns and the industry will suffer harm beyond description.

Under HR 45, if you can’t pass a complex test written by the U.S. Attorney General (described in detail below), pay the tax, give up fingerprints and a biometric-capable photo of yourself (that can be turned into a digital facial-recognition number and used as a de facto national ID), every gun you own will become contraband and subject to confiscation, while you stand trial before imprisonment. You’d think Bobby, a former black panther, would know better.

Your rights will have an expiration date, and if you screw up and miss it, you’ll be in the same mess as people who can’t pass the test. Can you say “unconstitutional”? Do you think these “gun bigots” care?

Now that the Supreme Court has made it clear in the Heller case that government can’t ban guns, the Brady’s have stopped saying they want to ban guns. So the virtually treasonous Bobby Rush bill doesn’t ban guns, it bans gun owners, maybe by the millions. How many gun owners read poorly or don’t test well? How many can’t explain local, state and federal gun laws? They’d become prohibited possessors under HR 45. Are there any limits to what the AG can put on the test? The bill doesn’t mention any — it gives the AG a free hand to include anything.

Had enough? HR 45 has an innocent-looking line that says ’strike the second sentence of 18 USC 926(a)’. That’s the line that says the federal government cannot make a central registry of gun owners.

The anti-rights people have to repeal that line, because Bobby’s bill flat-out creates a central gun registry. Every gun owner must be registered to keep on possessing the guns they already own, and any transfer of any kind must be registered as well. The mark of the beast is upon us, to apply a metaphor.

A Political Analysis Of General Election 2008

Professor Joseph Olson of Hemline University School of Law, St. Paul, Minnesota, points out some interesting facts concerning the Presidential election:

Number of States won by: Democrats: 19 Republicans: 29

Square miles of land won by: Democrats: 580,000 Republicans: 2,427,000

Population of counties won by: Democrats: 127 million Republicans: 143 million

Murder rate per 100,000 residents in counties won by: Democrats: 13.2 Republicans: 2.1

Professor Olson adds: "In aggregate, the map of the territory Republican won was mostly the land owned by the taxpaying citizens of the country. Democrat territory mostly encompassed those citizens living in government-owned tenements and living off various forms of government welfare..."

Olson believes the United States is now somewhere between the "complacency and apathy" phase of Professor Tyler's definition of democracy, with some forty percent of the nation's population already having reached the "governmental dependency" phase.

If Congress grants amnesty and citizenship to twenty million criminal invaders called illegals and they vote, then we can say goodbye to the USA in fewer than five years.

If you are in favor of this, then by all means, delete this message.

If you are not, then pass this along to help everyone realize just how much is at stake, knowing that apathy is the greatest danger to our freedom.

Oh, Do You Remember These?

'Someone asked the other day, 'What was your favorite fast food when you were growing up? ''We didn't have fast food when I was growing up,' I informed him. 'All the food was slow.'

'C'mon, seriously. Where did you eat?' 'It was a place called 'at home,'' I explained. ! 'Mom cooked every day and when Dad got home from work, we sat down together at the dining room table, and if I didn't like what she put on my plate I was allowed to sit there until I did like it.'

By this time, the kid was laughing so hard I was afraid he was going to suffer serious internal damage, so I didn't tell him the part about how I had to have permission to leave the table. But here are some other things I would have told him about my childhood if I figured his system could have handled it :Some parents NEVER owned their own house, wore Levis , set foot on a golf course, traveled out of the country or had a credit card. In their later years they had something called a revolving charge card The card was good only at Sears Roebuck. Or maybe it was Sears & Roebuck. Either way, there is no Roebuck anymore. Maybe he died.

My parents never drove me to soccer practice. This was mostly because we never had heard of soccer. I had a bicycle that weighed probably 50 pounds, and only had one speed, (slow). We didn't have a television in our house until I was2019.It was, of course, black and white, and the station went off the air at midnight, after playing the national anthem and a poem about God; it came back on the air at about 6 a.m. and there was usually a locally produced news and farm show on, featuring local people.

I was 21 before I tasted my first pizza, it was called 'pizza pie.' When I bit into it, I burned the roof of my mouth and the cheese slid off, swung down, plastered itself against my chin and burned that, too. It's still the best pizza I ever had.

I never had a telephone in my room. The only phone in the house was in the living room and it was on a party line. Before you could dial, you had to listen and make sure some people you didn't know weren't already using the line. Pizzas were not delivered to our home. But milk was. All newspapers were delivered by boys and all boys delivered newspapers -- my brother delivered a newspaper, six days a week. It cost 7 cents a paper, of which he got to keep 2 cents. He had to get up at 6AM every morning. On Saturday, he had to collect the 42 cents from his customers. His favorite customers were the ones who gave him 50 cents and told him to keep the change. His least favorite customers were the ones who seemed to never be home on collection day. Movie stars kissed with their mouths shut. At least, they did in the movies. There were no movie ratings because all movies were responsibly produced for everyone to enjoy viewing, without profanity or violence or most anything offensive.

If you grew up in a generation before there was fast food, you may want to share some of these memories with your children or grandchildren. Just don't blame me if they bust a gut laughing. Growing up isn't what it used to be, is it? MEMORIES from a friend :My Dad is cleaning out my grandmother's house (she died in December) and he brought me an old Royal Crown Cola bottle. In the bottle top was a stopper20with a bunch of holes in it.. I knew immediately what it was, but my daughter had no idea. She thought they had tried to make it a salt shaker or something. I knew it as the bottle that sat on the end of the ironing board to 'sprinkle' clothes with because we didn't have steam irons. Man, I am old. How many do you remember? Head lights dimmer switches on the floor. Ignition switches on the dashboard. Heaters mounted on the inside of the fire wall. Real ice boxes. Pant leg clips for bicycles without chain guards. Soldering irons you heat20on a gas burner. Using hand signals for cars without turn signals.
