CLS, ADF attorneys seek to defend federal law that protects medical professionals from mandatory participation in abortion

HARTFORD, Conn. — Attorneys with the Christian Legal Society and the Alliance Defense Fund filed motions to intervene Wednesday in three lawsuits that seek to invalidate a federal law protecting medical professionals from discrimination because they refuse to participate in abortions. Three pro-life medical associations are seeking to defend the law against challenges by some state officials, Planned Parenthood, and the National Family Planning and Reproductive Health Association, represented by the American Civil Liberties Union.

“Medical professionals should not be forced to perform abortions against their conscience. Planned Parenthood, the ACLU, and their pro-abortion allies are seeking to punish pro-life medical professionals for their beliefs,” said Litigation Counsel Casey Mattox with CLS’s Center for Law & Religious Freedom. “Far from arguing for ‘choice,’ these lawsuits seek to compel health care workers to perform abortions or face dire consequences.”

“For over three decades, federal law has prohibited recipients of federal grants from forcing medical professionals to participate in abortions. The arguments in the lawsuits themselves demonstrate lack of compliance with these laws and the necessity of the regulation they are challenging,” said ADF Legal Counsel Matt Bowman. Attorney Andrew Knott of Cheshire is assisting as local counsel.

The Christian Medical Association, Catholic Medical Association, and American Association of Pro-Life Obstetricians and Gynecologists, represented by CLS and ADF attorneys, are asking to be allowed to defend the law, 45 CFR Part 88, enacted in December 2008 by the U.S. Department of Health and Human Services. Noting a pattern of grant recipients unaware of or flouting existing laws protecting medical professionals’ rights of conscience, HHS enacted the new law to require grantees to certify compliance with them in order to receive funds. The three long-standing statutes are the Church Amendment, the Coats-Snowe Amendment, and the Weldon Amendment.

The three pro-life medical groups point out that denying rights of conscience could harm access to healthcare for all by forcing medical professionals who refuse to perform abortions to either relocate from jurisdictions that force them to do so or leave the profession altogether.

Many of those challenging the HHS law failed in previous efforts to have the Weldon Amendment struck down. Summers: Bush Tax Cuts Won't Be Extended

President Obama's senior economic advisor made clear Sunday that any idea of renewing the Bush tax cuts, set to expire in 2010, is a dead issue.

Lawrence H. Summers, a former Treasury secretary and head of the White House's National Economic Council, made clear to “Meet the Press” host David Gregory that Obama is committed to allowing the tax cuts to die.

Summers also left open the possibility that the administration may revoke the tax cuts early, an idea pushed by House Speaker Nancy Pelosi.

But he emphasized that the Obama administration is dead against extending the tax cuts, an idea favored by Republicans.

Asked if he was open to extending the cuts to 2013, Summers responded, "First, it's a bad idea because we simply can't afford it. The president's inherited a trillion-dollar deficit, and a deficit with a baseline that is terrible as far as the eye can see."

During the presidential campaign last year, Obama had pledged he would rescind the Bush tax cuts early and redirect the new revenues to tax cuts for lower and middle class wage earners. But in September, Obama indicated he might delay rescinding the tax cuts if he faced a severe recession. At the time he also insisted he would allow the tax cuts to expire no later than 2010.

The Heritage Foundation has warned that if the Bush tax cuts are allowed to expire, "taxes will rise dramatically for most taxpayers" with tax rates rising "substantially in each tax bracket, some by 450 basis points."

For example, top wage earners currently in the 35 percent tax bracket will see their tax rate increase to over 39 percent -- an increase of more than 10 percent in extra taxes they will have to pay.

Last year, the Bush White House claimed that allowing the tax cuts to expire would mean a family of four would have an additional tax burden of $1,900 annually. They also claimed 43 million families with children would see an increase of taxes over $2,000.

Honest “Wealth Re-distribution” Is Capitalism

Originally our Founders, inspired by God and common sense, wisely gave us a limited Government called a "Constitutional Republic." Originally, our taxes were used only to support national defense (Executive) and regulation of society (Legislative and Judicial). Later on taxes supported some land grants that assisted our settlers in establishing homes and private property, where they could begin a new life and work for their subsistence.

I believe the best and most honest form of “wealth re-distribution” is capitalism and free enterprise, within the framework of our Constitutional Republic, with free, responsible people working and earning wages making and selling products and services, and then spending their wages for other products and services, to pay the wages of other citizens’ careers. This is how our wealth should continue to be re-distributed - from person to person - without Government interference.

We don’t need dishonest “wealth re-distribution” by a socialistic form of government, using our taxes (without representation) for support of selfish, dishonest, lazy people.

Only honest, moral, unselfish, responsible people can be effectively governed by our unique American “limited government.”

Stimulus package explained

Sometime this year, taxpayers will receive an Economic Stimulus Payment. This is a very exciting new program that I will explain using the Q and A format:

Q. What is an Economic Stimulus Payment?
A. It is money that the federal government will send to taxpayers.

Q. Where will the government get this money?
A. From taxpayers.

Q. So the government is giving me back my own money?
A. No, they are borrowing it from China. Your children and grandchildren are expected to repay the Chinese.

Q. What is the purpose of this payment?
A.. The plan is that you will use the money to purchase a high-definition TV set, thus stimulating the economy.

Q. But isn't that stimulating the economy of China?
A. Shut up.

Below is some helpful specific advice on how to best help the US economy by spending your stimulus check wisely:

If you spend the money at Wal-Mart, all the money will go to China.
If you spend it on gasoline, it will go to Hugo Chavez, the Arabs, and Al Qaeda.
If you purchase a computer, it will go to Taiwan.
If you purchase fruit and vegetables, it will go to Mexico, Honduras, Chile, and Guatemala.
If you buy a car, it will go to Japan and Korea.
If you purchase prescription drugs, it will go to India.
If you purchase heroin, it will go to the Taliban in Afghanistan
If you give it to a charitable cause, it will go to Nigeria.

And none of that will help the American economy.

We need to keep that money here in America. You can keep the money in America.
